TERMS & CONDITIONS Rental Agreement 1. “Customer(s)”,”Ï”, “Me” And “My” refer to the person(s) in this agreement. 2. By using this agreement I understand that I am responsible for all sums due hereunder whether I am a passenger in a vehicle or not. 3. In the event that one or more of the stated vehicles to be provided hereunder is in an accident, has a mechanical breakdown or, for any other reason, is not available on the date(s) agreed upon under this agreement, customer understands that Queens Productions Limousine Service, can meet it’s obligations by providing a replacement limousine or limousines to adequately seat all members of a party without any liability, Queens Productions Limousine Service reserves the right to subcontract an independent owner/operator to fulfill it’s obligations under this agreement. Queens Productions Limousine reserves the right to substitute the limousine or the color of the vehicle at its own discretion. 4. In the event that Queens Productions Limousine Service is unable to comply with any of it’s obligations under this agreement, its sole liability shall be to return the customer’s deposit paid on the signing of this agreement. Unless otherwise specified, all reservations require a major credit card. 5. Customer agrees to pay the balance due under this agreement by cash, money order or charge on first date of service at time of pick-up. 6. Queens Productions Limousine shall not be held responsible for late arrival caused by (but not limited to) acts of nature, traffic delays, breakdown, incorrect pickup and drop-off information, and any situation beyond our control. 7. The number of persons stated on the other side of this agreement shall be the maximum number of persons entitled to ride in the provide vehicle(s) on the date(s) of service. 8. No drugs and/or controlled substances of any kind shall be permitted in any vehicle(s) provided under this agreement. in the event that drugs and/or controlled substances are found in the vehicle at any time in violation of this agreement Queens Productions, expressly reserves the right to terminate this agreement, discharge all passengers to leave the job site without any further obligations or liability. It is expressly understood that the customer shall not be entitled to any refund on the event. Queens Productions terminates this agreement for violation of this section. Customer shall remain liable for any overtime or extra charges incurred prior to termination. 9. In the event of any damage caused to vehicle and/or the interior and equipment therein by a member of a party, the customer expressly agrees to be responsible for any and all cost of repair. Repair charges shall be an “extra charge” added to the amount due on the other side of this agreement. 10. Customer agrees that Queens Productions Limousine Service’s obligations with respect to pick-up, drop off, stops and special instructions are limited to those obligations expressly stated on the other side of this agreement. 11. Customer agrees that Queens Productions Limousine Service will not be responsible for loss or damage to any property left at any time in any of the vehicle(s) provided under this agreement regardless of who is at fault. Customer shall be fully responsible for any expenses sustained by Queens Productions Limousine Service and all claims made by anyone for such loss or damage. 12. In the event that any member of a party becomes intoxicated or behaves in an unruly manner, Queens Productions Limousine Service shall be entitled to terminate this agreement, discharge all passengers and leave the job site without further obligations or liability. It is expressly understood that the customer shall not be entitled to any refund in the event Queens Productions Limousine Service terminates this agreement for violation of this section. Customer shall remain liable for any overtime or extra charges incurred prior to termination. In the event of sickness in vehicle resulting in vomiting in interior of vehicle(s) the customer shall be responsible for a clean up charge of $300.00. This charge shall be an “extra charge” added to the amount due on the other side of this agreement. 13. Customer agrees to pay all cost of collection including reasonable attorney’s fees if any amount due under this agreement is paid when due. 14. Any lawsuit brought by Queens Productions Limousine service against the customer arising out of this agreement shall be brought in the courts of New York State in the County where Queens Productions Limousine Service is located. In the event any part of this contract is declared unenforceable, the remaining provisions of this agreement shall remain in full force and effect. 15. Reservations are finalized upon receipt of a signed contract/agreement.
